Charges not filed in fatal bar fight

Prosecutors did not file charges Tuesday against two brothers arrested on suspicion of assault related to a weekend fight at a Newport Beach bar, officials said. The fight resulted in the death of a Tustin man.
Marc and Brian Weiner, both of Burbank, were arrested Saturday following an altercation at Muldoon’s Dublin Pub at Newport Center. Tustin resident Jason Boozer was punched in the face and hit his head on concrete. Boozer, 26, went unconscious and was taken to Hoag Hospital, where he died Sunday.
The Orange County district attorney’s office didn’t file charges against either of the brothers Tuesday, but that doesn’t mean they won’t, said Susan Kang Schroeder, spokeswoman for the district attorney’s office.
“We just don’t have a decision yet,” Schroeder said.
The district attorney’s office is looking into more information about the case, Schroeder said.
The Weiner brothers were arrested on suspicion of assault with a deadly weapon causing great bodily harm. Marc Weiner, 31, posted $25,000 bail Saturday. Brian Weiner, 35, who was being held in lieu of $100,000 bail, was expected to be released late Tuesday, authorities said.
Police said Boozer was punched in the face when the men were fighting over a comment made to a woman. The punch caused Boozer to fall backward and hit his head on concrete.
Boozer was out with friends celebrating a job promotion when the incident occurred, family members said. A graduate of El Toro High School in Lake Forest, Boozer worked for CB Richard Ellis, a realty firm with an office in Newport Beach.
