School Desegregation Plan Legal, Judge Rules

An Alameda County judge has ruled that the Berkeley school district’s desegregation plan doesn’t violate California’s ban on racial preferences.
Under the plan, the district is seeking to enroll a student population at each school that comes within 5% of the district’s overall racial population.
In a ruling released Wednesday, Superior Court Judge James Richman said the plan isn’t prohibited under Proposition 209, the 1996 voter-approved ban on racial and gender preferences.
