The Dulzura Cafe settled a lawsuit Friday filed by a racially mixed couple who claimed they were attacked outside of the restaurant in June, 1984, for racial reasons.
Luther Moore, who is black, and his wife, Rita, who is white, sued the popular restaurant after Luther Moore was attacked by two white men with a whip and chain while they made racial taunts on June 20, 1984.
San Diego Superior Court Judge Vincent DiFiglia approved the settlement Friday.
Attorneys from both sides said a confidentiality clause in the settlement prohibited them from disclosing the amount.
Attorney Jim Miller, who represented the Moores, said the suit against the restaurant was settled because the Dulzura couple didn’t have funds to continue litigating the suit.
Miller said the suit is still pending against three people, including the two men involved in the attack who both pleaded guilty to assault with a deadly weapon on Nov. 21, 1984.
