Gene Banks said the Chicago Bulls are refusing to pay him his guaranteed salary of $345,000 for the upcoming National Basketball Assn. season because he was hurt in a game in which he played without the team’s consent.

Banks, 28, said he expects to miss the 1987-88 season because of a ruptured Achilles tendon suffered during a Charles Baker Summer League game in Philadelphia.

In a letter from the Bulls’ law firm, Katten, Muchin and Zavis, Banks was told he had violated his contract by failing to obtain consent to play in the June 25 game. The letter said that unless Banks can play in the first game of the NBA season, he will be suspended and his salary reduced.
