The Law and Real Estate column correctly points out the difficulty of reconciling problems of probate attendant with community property and the tax cost attendant with joint tenancy property.
Unfortunately, the article fails to point out that a properly drafted, funded living trust can give you the benefit of avoiding probate and the tax benefits associated with community property. This is, in fact, the best of both worlds.
